What Is the Procedure for Criminal Court?

After you have been arrested, you will appear in court for your first appearance, or “arraignment.” This will be your first time in front of the judge for the crime that you were arrested for. During this first appearance, you will be made aware of the charges against you as well as your rights. This includes both your right to remain silent and your right to have an attorney. If your crime is a misdemeanor, you may even be asked at this time to enter your plea during the first appearance. If you plead guilty, then the judge may give you your sentence or postpone it in another hearing at a future date. If you choose to plead not guilty, then the judge will set a bail amount for you as well as a trial date. If your crime is a felony, then there are several things the judge may do. The judge may set bail for you, release you on your own recognizance, or deny your bail and send you back to wait in jail until your trial date. You will then attend a preliminary hearing in which the judge will determine what crime was committed and if you committed that crime. Once it is determined that you committed the crime, your trial begins.
