Why You Need a Domestic Violence Lawyer

Domestic violence charges are serious business New Mexico, and a domestic violence lawyer can be of tremendous assistance to you. If you are convicted of domestic violence, you will likely face harsh criminal penalties, including jail time and hefty fines. Moreover, a domestic violence charge or conviction on your record can have a serious impact on your life and on your relationships with others.

If you have been charged with domestic violence, you have a constitutional right to be represented by an attorney throughout your case. As such, it is best to exercise that constitutional right and seek experienced legal representation at Twohig Law Firm.

Domestic Violence Charges Under New Mexico Law

Under New Mexico law, you can be charged with domestic violence for intimidating someone or for hitting or touching someone in an offensive manner. Domestic violence law is very biased in favor of the alleged victim. This essentially means that you can be charged with domestic violence simply because your accuser alleges that you harmed — or threatened to harm — him or her.

The Importance of Retaining a Good Attorney in a Domestic Violence Case

Given the extremely serious nature of domestic violence charges, the importance of a good domestic violence lawyer in your case cannot be understated. Some of the most important reasons to retain legal counsel in a domestic violence case are as follows:

  • Domestic violence does not need to involve a physical assault on someone. Acting in a perceived controlling, threatening, or abusive manner can constitute domestic violence under the law, and it is oftentimes your word against that of the accuser.
  • The alleged victim’s word typically carries more weight in a domestic violence case than your word.
  • You will lose your right to carry a gun if you are convicted of domestic violence, unless your sentence is deferred and you satisfactorily complete probation. You will also be prohibited from owning a gun or from having a gun in your home. A conditional discharge can also overcome this collateral consequence.
  • Upon sustaining a domestic violence conviction, you may lose your job or be prohibited from working in a particular field, forcing you to embark on a new job search or change careers entirely. Moreover, since most employers now perform criminal background checks on prospective employees, a misdemeanor or felony domestic violence conviction may prevent you from obtaining employment in the future — or from gaining admission to college or some other educational institution or program.
  • A domestic violence conviction will remain on your permanent criminal record in perpetuity, unless you had a deferred sentence or a conditional discharge. Moreover, on any employment or higher education applications, when the question of criminal convictions arises, you must respond that you have previously been convicted of a crime. Also, under New Mexico law, you cannot expunge or seal domestic violence conviction records, and therefore, the conviction will remain on your criminal record for the rest of your life.
